long before the issuing of the eIDAS regulation that provided the framework for certified and qualified electronic delivery services. This is one of the reasons why electronic delivery services, in various forms, have become widely used in other European countries, while in Italy they have only recently appeared.
Since it was created long before the eIDAS regulation, PEC does not, for obvious reasons, have all the requirements of certified or qualified electronic delivery services: for this reason, its legal validity is limited solely to the Italian territory.
And here we come to a crucial point. PEC , in some respects, can be india whatsapp resource considered a Certified Electronic Delivery Service (SERC).
Please note, however: it cannot currently be considered a Qualified Certified Electronic Delivery Service (SERCQ).
The current PEC lacks some specific SERCQ requirements, such as guarantees on the sender and recipient . In fact, the PEC does not allow for the sender and recipient to be identified with certainty before sending the communication, nor does it provide for the affixing of a qualified timestamp issued by a qualified trust service provider.
Furthermore, there is no requirement that the operator must undergo compliance checks by the designated bodies .
And here, starting from these limits, the evolution path from the Italian PEC to the European PEC begins to take shape .
